How to report a suspected parent participation violation to CDE

Anyone may file a written special education state complaint alleging that a Colorado school district or other covered public agency violated IDEA or Colorado's Exceptional Children's Educational Act (ECEA). The Colorado Department of Education (CDE) decides whether to accept and investigate a complaint.

Start with CDE's official instructions: File a Special Education State Complaint ↗. The page provides the current form, procedures, and Spanish-language materials.

Step 1: Identify the specific alleged violation

For a school building relocation, consider whether the district failed to include parent participation in a decision changing the building or location where a student's IEP would be implemented, as required by 1 CCR 301-8, § 4.03(8)(b)(iii). Describe concrete actions and dates rather than assuming that every school closure automatically violates the rule.

Step 2: Gather relevant facts

Step 3: Write your complaint

You may adapt the following sample allegation. Only include facts that are true for your situation.

I allege that [district name] failed to comply with 1 CCR 301-8, § 4.03(8)(b)(iii), concerning parent participation in decisions changing the building or location where my child's IEP will be implemented. On [date], the district [describe the decision or notice]. I requested an opportunity to participate on [dates], but [describe the response or absence of participation]. The district has not explained how it considered the impact on my child's total educational program, including [specific concerns]. I request that CDE investigate whether the district complied with the rule and order appropriate corrective action if a violation is found.

Step 4: Include CDE's required information

CDE requires a signed written complaint containing your name, address, phone number, specific allegations, supporting facts, requested resolution to the extent known, and student/school identifying details when the allegation concerns an individual child. Its form also addresses providing a copy to the district.

Step 5: Submit to both CDE and the district

Important: CDE currently instructs complainants to send the signed complaint by mail or hand delivery to both CDE and the involved district's special education director (or relevant public agency). CDE does not currently accept these state complaints by email. Use the addresses and delivery instructions in the current official form; keep proof of delivery.

Deadlines and outcomes

CDE generally investigates alleged violations occurring within one year before it receives the complaint. A written decision generally must be issued within 60 calendar days after a properly filed complaint is received, subject to permitted extensions. Filing is free; you do not need an attorney. CDE may order corrective action for violations it finds, but it cannot order every remedy a family might want.

CDE's special education complaint process is not the same as a disability-discrimination complaint under Section 504 or the ADA. For those concerns, review federal OCR or Colorado civil-rights complaint options separately.
