Colorado special education rights

School closures do not automatically eliminate parent participation rights.

Key point: Colorado ECEA Rule 4.03(8)(b)(iii) requires parent participation in decisions changing the building or location where a child's IEP is implemented, even when the move is not a change in educational placement. It also requires due consideration of the impact on the child's total educational program.

What does the rule actually say?

The rule distinguishes a change in building or location from a change in educational placement. For a building-only change, the rule allows a move without an IEP team meeting or reevaluation, but it still says the decision must include parent participation. A building-only change ordinarily does not require prior written notice, subject to an exception elsewhere in the rule.

What about a district-wide school closure?

The building-change provision does not expressly exempt district-wide or system-wide decisions. However, the text does not explicitly require a district to consult every parent before voting to close a school. A school closure vote and the later decision about the building where a particular child's IEP will be implemented are legally distinct questions. Whether the timing and substance of parent participation were adequate is fact-specific and may be disputed.

Parents can reasonably ask how the district will involve them before it finalizes the building or location decision affecting their child, rather than presenting that individual decision as irreversible.

Questions to ask your district

  1. When was the decision made to move my child's IEP services to a different building, and who made it?
  2. How and when will I participate in that location decision before it is finalized?
  3. What consideration was given to my child's entire educational program, including accessibility, sensory environment, related services, transportation, safety, and extracurricular access?
  4. What documentation shows how parent input was considered?
  5. Does this move also change my child's educational placement or IEP services, triggering additional requirements?

What if the new building cannot implement the IEP?

A building-only move is different from a significant change in educational placement. If services, educational environment, or opportunities are materially changed, other provisions of § 4.03(8), IDEA, and the child's IEP may apply. Ask the district to explain its decision in writing and consider obtaining individualized advocacy advice.

Think the district did not include parents?

You may submit a special education state complaint to the Colorado Department of Education alleging a violation of the ECEA rule. CDE determines whether the allegations meet its investigation requirements and whether a violation occurred.
